Terms of Service for Photo Respot

Agreement to Terms

By downloading, installing, or using Photo Respot ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Photo Respot is a mobile application that lets you document how places change over time using AR-guided rephotography, interactive timeline comparison, sound recordings, and AI change detection.

Account and Data

No Account Required

Photo Respot does not require you to create an account. Your data is stored locally on your device or in your personal iCloud account.

Your Responsibility

You are responsible for:

• Maintaining the security of your device
• Backing up your data
• Any activity that occurs through your use of the App
• Ensuring you have the right to photograph locations and record audio in your jurisdiction

Subscriptions and Payments

Free Features

The basic version of Photo Respot is free to use and includes up to 5 spots, basic photo comparison (slider and side-by-side), map view, and 1 sound recording per spot.

Premium Subscription

• Premium features require a paid subscription
• Premium unlocks unlimited spots, AI change detection, unlimited sound recordings, private mode, timeline export, and advanced reminders
• Subscription prices are displayed in the App and may vary by region
• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription in your Apple ID settings

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple: https://support.apple.com/en-us/HT204084

User Content

Your Content

You retain full ownership of all photos, audio recordings, and other content you create within the App. We do not claim any rights to your content.

License to Us

By using the App, you grant us a limited license to store and process your content solely to provide the App's functionality (e.g., storing spot data, performing on-device change detection).

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Photograph or record audio in locations where it is prohibited by law
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Interfere with or disrupt the App's functionality

Intellectual Property

Our Rights

Photo Respot, including its design, features, and content, is owned by Eplep.ai and protected by copyright and other intellectual property laws.

Your Rights

You retain ownership of any content you create within the App.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• AR positioning will be perfectly accurate in all conditions
• AI change detection results will be completely accurate

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPLEP.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Eplep.ai from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Termination

By You

You may stop using the App at any time by uninstalling it.

By Us

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App.

Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with Norwegian law, except where prohibited by law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eplep.ai regarding the App.
