Terms of Service for Hearby

Agreement to Terms

By downloading, installing, or using Hearby ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Hearby is a mobile application that lets you record audio clips at physical locations and discover clips left by others when you are nearby.

Account and Data

Sign in with Apple

Hearby uses Sign in with Apple for authentication. Your Apple ID credentials are managed by Apple and we do not have access to your Apple ID password.

Your Responsibility

You are responsible for:

• Maintaining the security of your device
• Backing up your data
• Any activity that occurs through your use of the App
• Content you record and share with others

Subscriptions and Payments

Free Features

The basic version of Hearby includes:

• 5 active clips
• 30 second recordings
• 3 month clip lifespan
• 10 meter listening radius

Premium Subscription

• Premium features require a paid subscription
• Subscription prices are displayed in the App and may vary by region
• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription in your Apple ID settings

Free Trial

Premium includes a 7-day free trial. No payment information is required to start the trial.

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple: https://support.apple.com/en-us/HT204084

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Record or share content that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to harass, abuse, or harm others
• Transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Record content in locations where recording is prohibited

Content Moderation

Reporting

Users can report inappropriate content through the in-app reporting feature.

Enforcement

We reserve the right to:

• Remove content that violates these Terms
• Temporarily or permanently ban users who violate these Terms
• Cooperate with law enforcement if required

Intellectual Property

Our Rights

Hearby, including its design, features, and content, is owned by Eplep.ai and protected by copyright and other intellectual property laws.

Your Rights

You retain ownership of any content you create within the App. By using the App, you grant us a limited license to store and process your content solely to provide the App's functionality.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements

Location Services

Hearby requires location access to function. We are not responsible for any issues arising from inaccurate location data or location services being unavailable.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPLEP.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Eplep.ai from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Termination

By You

You may stop using the App at any time by uninstalling it.

By Us

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App.

Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with Norwegian law, except where prohibited by law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eplep.ai regarding the App.
