Terms of Service for Iterator

Agreement to Terms

By downloading, installing, or using Iterator ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Iterator is a mobile application that helps you brainstorm and iterate on names, slogans, concepts, and ideas using AI-powered suggestions. You describe what you need, receive suggestions, and can iterate on any direction until you find the perfect result.

Account and Data

No Account Required

Iterator does not require you to create an account. Your data is stored locally on your device.

Your Responsibility

You are responsible for:

• Maintaining the security of your device
• Backing up your data
• Any activity that occurs through your use of the App
• Ensuring your use of generated content complies with applicable laws

AI-Generated Content

Your Responsibility for Generated Content

You are solely responsible for:

• Verifying that any name, slogan, or concept you use is not trademarked or copyrighted by others
• Conducting appropriate searches before using generated content commercially
• Any legal consequences arising from your use of generated content

No Warranties on Generated Content

We do not warrant that generated suggestions are:

• Original or unique
• Free from trademark conflicts
• Suitable for any particular purpose
• Accurate or appropriate

Subscriptions and Payments

Free Features

• 10 iterations per day
• View and navigate idea trees
• Access iteration history

Premium Subscription (29 kr/month)

• Unlimited iterations (fair use policy applies)
• Save favorites
• Export idea trees
• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription in your Apple ID settings

Fair Use Policy

Premium subscriptions include a fair use limit of 300 iterations per day to ensure service quality for all users.

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple: https://support.apple.com/en-us/HT204084

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Generate content that is hateful, harassing, or harmful
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to harass, abuse, or harm others
• Transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Attempt to bypass usage limits or abuse the service
• Use automated tools to interact with the App

Intellectual Property

Our Rights

Iterator, including its design, features, and content, is owned by Eplep.ai and protected by copyright and other intellectual property laws.

Your Rights

You retain ownership of:

• The prompts you enter
• Your selection and arrangement of generated content
• Any derivative works you create using the suggestions as inspiration

AI-Generated Content

Suggestions generated by the AI are provided to you for your use. You may use these suggestions for personal or commercial purposes, subject to the disclaimers above regarding trademark and copyright verification.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• Generated suggestions will be suitable for your needs
• The AI service will always be available

Third-Party Services

The App relies on Anthropic's Claude API. We are not responsible for:

• Downtime or unavailability of the AI service
• Changes to the AI's capabilities or behavior
• Content generated by the AI

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPLEP.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Eplep.ai from any claims, damages, or expenses arising from:

• Your use of the App
• Your use of generated content
• Your violation of these Terms
• Your violation of any third-party rights

Termination

By You

You may stop using the App at any time by uninstalling it.

By Us

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App.

Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with Norwegian law, except where prohibited by law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eplep.ai regarding the App.
