Terms of Service for Focus Battles

Agreement to Terms

By downloading, installing, or using Focus Battles ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Focus Battles is a mobile application that combines the Pomodoro focus technique with real-time player-versus-player battles. Users compete to maintain focus, with leaving the app resulting in "damage" to their avatar that opponents can see in real-time.

Account and Data

No Account Required

Focus Battles does not require you to create an account. Your data is stored locally on your device or in your personal iCloud account.

Game Center

The App uses Apple Game Center for leaderboards and achievements. Your Game Center profile and scores are subject to Apple's terms of service.

Your Responsibility

You are responsible for:

• Maintaining the security of your device
• Backing up your data
• Any activity that occurs through your use of the App

Subscriptions and Payments

Free Features

The basic version of Focus Battles is free to use with:

• 3 battles per day
• 12 free avatars
• Standard frames
• Access to leaderboards

Premium Subscription

• Premium features require a paid subscription
• Subscription prices are displayed in the App and may vary by region
• Payment is processed through Apple's App Store
• Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription in your Apple ID settings

In-App Purchases

• Extra lives, frames, and special avatars may be purchased individually
• All purchases are non-refundable except as required by law

Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple: https://support.apple.com/en-us/HT204084

Acceptable Use

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Remove or alter any proprietary notices or labels
• Use the App to harass, abuse, or harm others
• Transmit viruses or malicious code
• Interfere with or disrupt the App's functionality
• Cheat or exploit bugs to gain unfair advantages in battles
• Use automated tools or bots to play battles

Intellectual Property

Our Rights

Focus Battles, including its design, features, and content, is owned by Eplep.ai and protected by copyright and other intellectual property laws.

Your Rights

You retain ownership of any content you create within the App. By using the App, you grant us a limited license to store and process your content solely to provide the App's functionality.

Disclaimers

"As Is" Service

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

No Guarantee

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App will meet your specific requirements
• Multiplayer matching will always be available

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EPLEP.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Eplep.ai from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

Termination

By You

You may stop using the App at any time by uninstalling it.

By Us

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

Changes to Terms

We may modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the new Terms. We will notify you of significant changes through the App.

Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with Norwegian law, except where prohibited by law.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eplep.ai regarding the App.
